Terms of Service
These Terms of Service ("Terms") apply when you visit or use this website, including the blog and the contact form (the "Site"), which is operated by Monopage ("we", "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site. Our Privacy Policy explains how we handle personal information and forms part of how the Site works.
1. Using the Site
You may use the Site for lawful purposes, to learn about our services and to read our guides. When you use it, you agree not to:
- Break any law or infringe anyone's rights
- Try to gain unauthorized access to the Site, our systems, or other users' information
- Introduce malware, or interfere with or overload the Site
- Use bots, scrapers, or other automated tools to copy the Site at scale, or to send spam through the contact form
- Submit information that is false, misleading, defamatory, or unlawful, or that belongs to someone else without permission
- Pretend to be another person or business
We may block access to the Site, remove submissions, or take other steps if we reasonably think these Terms have been broken.
2. Information on the Site is general only
The guides and other content on the Site are published for general information and education. We work to keep them accurate and useful, but websites, search engines, platforms, and laws change, and we cannot promise that everything is complete or current. Nothing on the Site is legal, financial, tax, accessibility-compliance, or other professional advice, and it should not be relied on as such. This applies especially to articles about privacy, data protection, accessibility, taxes, and online selling. Laws differ by place, so speak to a qualified professional about your situation. Any results mentioned, such as better search visibility or more enquiries, are not guaranteed.
3. Our services
The Site describes the kinds of work we do, such as website design, development, and maintenance. Descriptions of packages, features, timelines, and any prices on the Site are for general information. They are not offers that you can accept by using the Site.
If you want to hire us, we will agree the scope, price, timeline, ownership of the finished work, and other terms with you in a written proposal, statement of work, or service agreement. That written agreement, once both sides accept it, governs the services. If it conflicts with these Terms, the written agreement wins for the services it covers.
4. Enquiries and the contact form
When you send us an enquiry, you agree that the information you provide is accurate and that you are allowed to share it. Sending an enquiry does not create a contract, and we are not obliged to reply, to accept any project, or to give a quote. Please do not send confidential, sensitive, or secret information through the contact form. Until we have agreed otherwise in writing, we do not treat enquiries as confidential beyond what our Privacy Policy describes.
5. Intellectual property
The Site, including its text, articles, graphics, logo, design, and code, belongs to Monopage or its licensors and is protected by copyright and other laws. We give you a limited, non-exclusive, non-transferable permission to view the Site and to print or share links to individual pages for personal or internal business use. Beyond that, you may not copy, republish, sell, or create derivative works from the Site's content without our written permission. Short quotations with a clear link back to the original page are fine.
Names, logos, and screenshots of other businesses and projects shown on the Site belong to their respective owners. Where we show example projects, we use them to illustrate our work, and showing them does not mean those owners endorse us.
If you send us feedback or suggestions, you agree we may use them without any obligation to you.
6. Third-party sites and services
The Site links to websites and uses services that we do not own or control, such as our form provider, hosting provider, and font provider. We are not responsible for their content, availability, or practices, and a link is not an endorsement. Your use of other sites is governed by their own terms.
7. Availability
We try to keep the Site available, but we do not promise that it will always be available, error free, or secure. We may change, suspend, or remove any part of the Site at any time without notice.
8. Disclaimers
To the fullest extent the law allows, the Site and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied. This includes warranties of accuracy, fitness for a particular purpose, and non-infringement. Some places do not allow certain disclaimers, so some of this may not apply to you.
9. Limitation of liability
To the fullest extent the law allows, Monopage and the people who work with us are not liable for any indirect, incidental, special, consequential, or punitive loss, or for loss of profit, revenue, data, or goodwill, arising from your use of the Site or reliance on its content. Our total liability for any claim relating to the Site is limited to one hundred US dollars (US$100) or the equivalent in your currency.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, such as liability for fraud or for death or personal injury caused by negligence, or any rights you have as a consumer that cannot be waived. Liability for our services is governed by the written agreement for those services, not by this section.
10. Your responsibility
You are responsible for your own use of the Site. You agree to be responsible for losses we suffer because you breached these Terms or misused the Site, to the extent the law allows.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the effective date at the top of the page. By continuing to use the Site after a change takes effect, you accept the updated Terms. If you do not accept them, you should stop using the Site.
12. Ending your access
You can stop using the Site at any time. We may suspend or end your access at any time if we reasonably believe you have broken these Terms. Sections that by their nature should continue, such as intellectual property, disclaimers, and limits of liability, continue after your access ends.
13. General
If any part of these Terms is found to be unenforceable, the rest stays in effect. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these Terms to anyone else. We may transfer ours to a successor of our business. These Terms and our Privacy Policy are the whole agreement between you and us about your use of the Site.
14. Governing law
These Terms, and any dispute arising from them, are governed by the laws of the place where Monopage is established, without regard to conflict-of-law rules, except where the law of the country where you live gives you rights that cannot be waived by contract.
15. Contact us
